The order of operations for launching a U.S. motor carrier may be about to change. Today, a new carrier can certify that it understands federal safety rules, receive operating authority, begin hauling freight, and face its substantive safety audit later. The Federal Motor Carrier Safety Administration (FMCSA) is reconsidering whether knowledge should be verified before the first load moves.

That is more than a regulatory detail. If the agency creates a pre-operation proficiency examination, brokers and shippers may need to redesign new-carrier onboarding around a clear distinction: an applicant can be commercially attractive without yet being operationally eligible.

A 17-Year-Old Proposal Is Moving Again

The rulemaking is formally called the New Entrant Safety Assurance Process. According to FreightWaves' review of the federal regulatory agenda, FMCSA is targeting November 2026 for a supplemental advance notice of proposed rulemaking. The initiative has been largely dormant since 2009, so the date is a milestone—not a guarantee of an immediate final rule.

Under the current model, FMCSA monitors a carrier during an 18-month new-entrant period and conducts a safety audit after operations begin. That audit can evaluate evidence that cannot exist before launch: driver logs, vehicle-maintenance histories, drug-testing records, roadside inspections, and actual operating performance.

A pre-operation exam would serve a different purpose. It could test whether an applicant understands its obligations before authority is granted. It would not replace ongoing monitoring or a performance audit. The likely future model is therefore two gates:

  1. Knowledge before authority: Demonstrate command of applicable safety requirements.
  2. Performance after launch: Prove through records and operating results that the safety program works.

The exact format, scope, cost, and implementation timeline remain undecided. Capacity teams should treat the proposal as a planning signal, not as a current mandate.

Why Earlier Verification Matters

The safety case is supported by sobering data. A 2024 FreightWaves report based on FMCSA analysis found that the share of fatal large-truck and bus crashes involving new-entrant carriers rose from 4.6% in 2017 to 7.4% in 2022. Those 2022 crashes resulted in 494 deaths and more than $5.5 billion in costs. Carriers within 24 months of graduating from the new-entrant program also recorded twice as many total crashes—and nearly twice as many fatal crashes per 100 power units—as comparable established carriers.

A test alone cannot prove that a carrier will operate safely. It can, however, expose foundational gaps before equipment enters mixed traffic: misunderstanding hours-of-service limits, failing to establish required drug and alcohol testing, using an unqualified driver, or neglecting systematic vehicle inspection and maintenance.

Earlier verification also supports fraud controls. Carrier identity and safety compliance are different risks, but both belong at the front door. Inbound Logistics reported that deceptive pickup schemes increased 31% year over year in the first quarter of 2026. One major shipper's vetting standard described in the report requires at least 180 days of interstate authority and $1 million in commercial general liability coverage, while also reviewing authority, business affiliations, safety records, drivers, and equipment.

That example should not become a universal cutoff that automatically excludes legitimate startups. It does show why a single "active authority" field is no longer enough for a defensible onboarding decision.

What Carrier Onboarding May Need Earlier

Most transportation teams already collect a W-9, operating authority, insurance certificate, and payment details. A pre-operation regime would make the sequence and status of those checks more important. A practical onboarding record should separate five evidence groups:

  • Authority: USDOT and MC identifiers, authority status, legal name, physical address, ownership, and the date authority becomes effective.
  • Insurance: Required liability and cargo policies, limits, effective dates, insurer confirmation, cancellation notices, and name matching across records.
  • Safety readiness: Evidence of the applicant's exam or pre-operation approval when required, plus the date and source of verification.
  • Drivers and equipment: Commercial driver's license and medical qualification controls, drug and alcohol program enrollment, vehicle ownership or lease records, inspection schedules, and equipment identifiers.
  • Operating performance: Roadside inspections, crashes, safety-rating changes, claims, service history, and internal exception trends after activation.

The TMS should retain when each check occurred, who or what performed it, what source was consulted, and when it must be refreshed. A screenshot stored in a shared folder is weak evidence because it cannot reliably drive an expiration rule or stop a tender.

Build a Workflow That Protects Capacity

The wrong response is to block every new carrier until it develops a long history. That protects incumbents more than it protects freight. New entrants can add valuable capacity, especially in tight regional or specialized markets.

Instead, use progressive status controls:

Applicant means the carrier may submit documents but cannot receive tenders. Conditionally verified means identity, authority, and insurance have cleared, while a required pre-operation credential or another control remains pending. Active means every mandatory gate has passed. Restricted allows only approved lanes, facilities, commodities, or load values. Suspended immediately prevents new tenders when authority, insurance, identity, or safety data changes.

These statuses should connect directly to execution. If a carrier is not active for the shipment's risk profile, the tender should fail automatically—not rely on a dispatcher remembering a note. The system can still preserve capacity by keeping incomplete applicants visible, routing exceptions to a compliance queue, and alerting teams when a pending credential clears.

After activation, verification must continue. Recheck authority and insurance before tender acceptance, match the arriving driver and equipment to the assigned load, and monitor material changes. Pre-operation approval would establish a baseline; it would not make a carrier permanently safe.

Prepare Now Without Predicting the Final Rule

Transportation leaders do not need to wait for final regulatory language to improve the process. Map every onboarding field to its source, owner, refresh interval, and tender consequence. Separate pre-qualification from activation. Make pending requirements machine-readable. Test how quickly the team can suspend a provider and reassign freight when a credential changes.

This architecture is useful even if FMCSA delays or substantially revises the proposal. It reduces manual decisions, strengthens the audit trail, and gives promising new carriers a transparent path to eligibility instead of an opaque rejection.
