An August 2026 government report alleged that more than 40 countries helped route Chinese exports around U.S. tariffs by directing goods through jurisdictions subject to lower duties, according to SupplyChainBrain. For importers, that claim changes the operational question. It is no longer enough to possess a certificate that names the final exporting country. Companies must be able to show why that origin is legally and factually correct.
The financial exposure is substantial. A 2025 U.S. executive order established an additional 40% duty for goods determined to have been illegally rerouted to conceal their origin, Reuters reported. That penalty can erase the margin on a shipment before legal fees, delays, storage, and customer disruption enter the calculation.
Transshipment Is Not Automatically Evasionβ
Moving goods through an intermediate country is a routine part of global logistics. Cargo may be consolidated at a regional hub, transferred between modes, stored in a free-trade zone, or processed by a supplier in another country. The compliance issue is whether the declared country of origin reflects a legitimate production process or merely disguises where the product was made.
The dividing line is generally substantial transformation: did processing in the intermediate country create an article with a new name, character, or use? The answer depends on the product and applicable customs rulings. Meaningful assembly, complex manufacturing, or a material change in function may support a new origin. Repacking, relabeling, sorting, minor finishing, or routing an unchanged product through a new port generally will not.

Maintain the legal name, address, registration, beneficial ownership, and banking details for the contracting supplier and actual factory. Record subcontractors and related parties. A supplier incorporated in one country but paid through, managed from, or wholly dependent on a manufacturer in another warrants additional review. Periodic facility verification should confirm that the named producer has the equipment, workforce, and capacity required for the order volume.

Collect bills of materials, component origins, production orders, labor records, machine logs, yield reports, and dated factory photographs where risk justifies them. The file should explain exactly what processing occurred, its cost and duration, and how it changed the imported article. Importers should also preserve product-specific origin analyses and customs rulings rather than relying on a supplier's general assurance.
3. Routing and custody recordsβ
Link bookings, bills of lading, container numbers, seal events, transload records, warehouse receipts, and arrival and departure dates. Compare the claimed production window with cargo movement. If a finished shipment leaves an intermediate country shortly after arriving from China, or the volume exceeds local production capacity, the chronology deserves escalation.
4. Customs and valuation recordsβ
Connect the commercial invoice, packing list, certificate of origin, HTS classification, entry summary, declared value, duty calculation, and broker instructions. Values should reconcile across the purchase order, payment, export declaration, and import entry. Sudden unit-value drops, vague product descriptions, inconsistent weights, or unexplained changes in classification are not clerical details; they are risk signals.
Turn the Evidence Into an Exception Workflowβ
A defensible control program does not manually investigate every shipment. It scores risk and routes exceptions before filing or release.
Start with three dimensions. Origin risk captures countries, sectors, and suppliers associated with circumvention allegations. Route risk detects unnecessary detours, short dwell times, unusual free-zone movements, and mismatches between factory and port. Value risk compares the shipment's unit price, freight, weight, and classification with historical and market ranges.

The workflow should also retain rejected documents and supplier corrections; an audit trail that shows a functioning control is stronger than a folder containing only the final version.
