The temporary federal hours-of-service waiver for gasoline and diesel haulers creates more scheduling flexibility, but it does not create 16 hours of safe driving capacity. That distinction should shape every dispatch decision made under the relief.

Effective September 16 through December 16, 2026, qualifying drivers can operate within a 16-hour period in a 24-hour window rather than the usual 14-hour window. As Logistics Management explains, the change does not authorize 16 hours behind the wheel. The normal federal limit generally permits up to 11 hours of driving after 10 consecutive hours off duty.

For fuel carriers facing urgent terminal releases, rural replenishment, or disrupted supply lanes, the extra window can prevent a load from stopping just short of its destination. Used carelessly, however, it can also convert terminal delays and poor planning into longer exposure for a tired driver hauling hazardous cargo.

Know exactly what the waiver changes

The relief applies to the transportation of gasoline and diesel by eligible drivers and motor carriers in good standing with the U.S. Department of Transportation. Carriers with a conditional safety rating or an active out-of-service order are excluded. The waiver also carries rest and reporting conditions.

SupplyChainBrain reports that drivers must take at least six consecutive hours in a sleeper berth during the 24-hour period, or eight consecutive hours off when the vehicle has no sleeper berth. Carriers must report crashes to the Federal Motor Carrier Safety Administration within two business days.

Those conditions make eligibility a shipment-level control, not a general permission setting. Dispatch should confirm that the carrier, driver, vehicle, commodity, dates, and movement all qualify before planning beyond the standard window. It should also preserve the evidence used for that decision.

Most importantly, legal availability is only the first test. A driver can be legally eligible and still be unfit for the proposed assignment because of prior duty, poor sleep, illness, heat exposure, an unusually demanding route, or a string of night shifts.

Put every extended assignment through four gates

A fatigue-safe dispatch gate should produce a clear approve, revise, or reject outcome. It should use current operational data rather than a dispatcher’s intuition alone.

1. Duty-history gate

Start with the electronic logging device record and the driver’s recent schedule. Confirm current driving time, on-duty time, qualifying rest, previous shift end, consecutive workdays, and any adverse-condition use. Look beyond remaining legal hours: repeated early starts, rotating day and night work, and several long duty periods can accumulate fatigue even when each log is compliant.

Require an affirmative driver fitness check before dispatch. Drivers must be able to decline or pause an assignment without pressure when they need rest. A waiver is not a defense against operating while impaired by fatigue.

2. Urgency and eligibility gate

Define why the load needs the extended window. A hospital generator, emergency-services depot, airport, utility restoration site, or community facing a genuine shortage has a stronger operational case than a routine replenishment load that missed an internal cutoff.

Capture the fuel type, origin terminal, delivery point, customer need-by time, waiver dates, carrier safety status, and approving manager. If the movement or carrier does not qualify, return it to normal hours-of-service planning. Do not let “fuel-related” become a catch-all category.

3. Terminal and route gate

Calculate the full duty cycle, not merely the linehaul mileage. Include travel to the terminal, queue time, loading, document checks, traffic, weather, delivery setup, unloading, site access, breaks, and the trip to a safe rest location or home base.

Terminal delay is the biggest variable dispatch can underestimate. A two-hour queue can consume the very flexibility intended to complete the delivery. Use live appointment and queue information when available, then add a conservative buffer. Establish a latest safe departure time and a hard turn-back or relief-driver trigger before the truck leaves.

4. Return-to-base gate

Every approval needs a credible end state. The plan should identify where the driver will finish, how much non-driving work remains, and whether suitable parking or a sleeper berth is available. If the projected return depends on perfect traffic, immediate unloading, or no customer delay, the plan is not resilient enough.

Dispatch should also identify the recovery option: swap drivers, stage the tanker, reschedule the stop, or route to an approved safe haven. The extended window must never become an expectation that a driver will improvise after the plan fails.

Record the exception as structured operational data

Phone calls and free-text notes are not sufficient for a temporary regulatory exception. The transportation workflow should retain:

  • waiver applicability and expiration date;
  • carrier and driver eligibility checks;
  • duty history and required rest calculation;
  • commodity, terminal, destination, and customer urgency;
  • expected terminal wait and route duration;
  • planned completion and safe-rest location;
  • driver fitness confirmation;
  • dispatcher and manager approvals; and
  • deviations, crashes, or other reportable events.

Time-stamped records protect both the driver and the carrier. They also make it possible to audit whether extended-window loads actually improved service or merely absorbed avoidable delays.

Measure capacity gained without hiding risk

The waiver arrives during a difficult trucking market. FreightWaves reports that truckload capacity continues to exit, a reminder that available equipment and qualified drivers cannot be assumed. Yet an extra two hours in an operating window should not be counted as two hours of new fleet capacity.

Track completed emergency deliveries, gallons moved, preventable stockouts, terminal dwell, extended-window frequency, driver declines, route deviations, and safety events. Compare those results with normal-window moves. If most extended assignments are caused by recurring terminal congestion or poor tender timing, fix the root process instead of normalizing longer days.
